Independent Contractor vs Employee

The classification of workers as independent contractors versus employees has significant insurance, tax, and legal implications for roofing companies. Employees are covered under your workers compensation policy, you pay payroll taxes on their wages, and they are included in your premium calculations. Independent contractors are responsible for their own insurance, taxes, and business expenses. Misclassifying employees as independent contractors to avoid insurance costs is one of the most common and costly compliance failures in the roofing industry.

The IRS and state agencies use several factors to determine worker classification, including behavioral control (do you direct how and when they work?), financial control (do you set their pay rate, provide tools, and control their expenses?), and the type of relationship (is the work ongoing, do you provide benefits, is there a written contract?). A roofer who works exclusively for your company, uses your tools, follows your schedule, and works under your direct supervision is almost certainly an employee regardless of what your contract says.

If a worker you classify as an independent contractor is injured and does not have their own workers comp, they can file a claim against your policy or sue you directly. Your workers comp carrier may then reclassify all similar workers as employees and charge you back premium for the entire policy period. State agencies can impose penalties, back taxes, and interest. In some states, misclassification is a criminal offense. To properly use independent contractors in your roofing business, ensure they have their own insurance (verify with certificates), operate under their own business entity, control their own methods and schedule, and work for multiple clients. Document the relationship with a written independent contractor agreement reviewed by an attorney.
